General terms and conditions
The following General Terms and Conditions apply to the purchase of tickets for Thuringia Bach Festival events organised by Thüringer Bachwochen e.V., Hugo-John-Strasse 8, D-99086 Erfurt, Germany. Thüringer Bachwochen e.V. is the customer's contractual partner. The advance booking offices only mediate the contractual relationship between the Thüringer Bachwochen e.V. and the customer.
Conclusion of contract
The contract between the Thüringer Bachwochen e.V. and the customer can only be concluded via the online shop or via the advance booking offices in Thuringia commissioned with ticket sales. When ordering in the online shop, the customer sends an offer to conclude a contract to the Thüringer Bachwochen e.V. The customer must provide correct information about his identity, address and payment details. The customer will immediately receive a confirmation of receipt. The acceptance of the offer - the conclusion of the contract - is effected by a further booking confirmation or the sending of the tickets. In the case of purchase via the advance booking offices, the contract is concluded through the mediation of the advance booking offices commissioned with ticket sales by means of corresponding declarations, the dispatch or the handing over of the tickets.
Privacy policy
Within the framework of the ordering process in the online shop, we record the customer's personal data in our customer database with the customer's consent. For the handling of the order process the necessary data is passed on to egocentric Systems GmbH, which uses it only for the handling of the order process. Otherwise, no data will be passed on to third parties. If you do not agree to be included in our customer database, we will delete the data at your request after the order process has been completed.
Tickets pick-up, shipping, delivery area
With the shipping options offered via our ticket shop, tickets are delivered by postal service provider in addition to being sent as an online ticket. Delivery can be made worldwide on request.
Prices, reservation fee, shipping costs
The prices stated for tickets on the internet and in the advance booking offices commissioned with ticket sales are inclusive of advance booking and system fees as well as the statutory value-added tax. For the shipping options via our ticket shop, additional shipping costs will be incurred if the tickets are sent by postal service provider, depending on the price list of the postal service provider commissioned.
Payment
Payment of the price plus any fees or shipping costs is due immediately after conclusion of the contract. The method of payment depends on the selected advance booking office and can be made by EC card, credit card, PayPal or advance payment and in person at the advance booking offices also in cash. In the case of the advance payment option, the amount can be paid by bank transfer to the account specified in the booking confirmation, which you will receive by e-mail or post. As long as full payment has not been made, the Thüringer Bachwochen e.V. reserves the right of retention. Should a payment be charged back, the Thüringer Bachwochen e.V. is entitled to the immediate return of the tickets ordered. The customer shall compensate the Thüringer Bachwochen e.V. for any damage resulting from the chargeback. If the tickets are not returned within 7 days of the customer being notified of the chargeback, the Thüringer Bachwochen e.V. is entitled, but not obliged, to withdraw from the contract and sell the tickets elsewhere.
No return, no replacement
There is no legal right of return or cancellation. An exchange or return of already purchased tickets is generally excluded. No compensation can be made for missed events. Changes in the programme and cast as well as relocation of venues are not intended, but are reserved and do not entitle the holder to exchange or return tickets. In the event of loss of tickets after receipt, neither replacement nor refund will be possible.
Cancellation of the event, rescheduling of the date
If the event is cancelled for any reason whatsoever, Thüringer Bachwochen e.V. will refund the price paid to the customer. In the event of the date being postponed, the customer may withdraw from the contract in return for reimbursement of the price paid. In both cases, the Thüringer Bachwochen e.V. will endeavour to inform the customer immediately. The refund of the price will be made exclusively - regardless of whether purchased via the online shop or an advance booking office - against return of the tickets to the Thüringer Bachwochen e.V.
House regulations
Customers may be refused entry if they disturb the event or other visitors or if such behaviour is to be feared. Sound, film, photo and video recordings are strictly prohibited during the event. Smoking is prohibited. Animals may not be brought into venues. The instructions of the staff must be followed unconditionally and without restriction.
Consent to the use of photographs & film recordings
With the purchase of the ticket, the customer agrees in accordance with Article 6 of the DSGVO that photos and/or film recordings of persons or groups of persons may be taken during the event and used for advertising or promotional purposes in print products or on the internet as part of the tasks of the Thüringer Bachwochen e.V..
Liability
The liability of the Thüringer Bachwochen e.V. for damages based on contractual, quasi-contractual, tortious or other legal grounds is excluded; this does not apply in the case of injury to life, body or health or if the injury is based on intentional or grossly negligent behaviour of the Thüringer Bachwochen e.V. or their vicarious agents or if it concerns the breach of an obligation essential for the achievement of the purpose of the contract. Furthermore, other legally mandatory liability claims remain unaffected.
Final provisions
Should parts of these terms and conditions be invalid, the validity of the contract or the remaining terms and conditions shall not be affected. The law of the Federal Republic of Germany shall apply.
